INFORMATIVA PRIVACY - REGOLAMENTO UE 679/2016 – G.D.P.R.

Io, Danilo Tambone, con sede in Milano, nello svolgimento della mia attività di Transformative Coach, dichiaro di rispettare quanto previsto dal Regolamento UE 679/2016 – GDPR, in termini di protezione dei dati personali, e di adottare comportamenti proattivi e tali da dimostrare la concreta adozione di misure finalizzate ad assicurare l'applicazione del regolamento e tutelare i diritti e le libertà degli interessati. Di seguito vengono riassunte tutte le informazioni rilevanti.

Non ci sono altre figure, oltre al titolare, che abbiano accesso ai dati del cliente (coachee).

TIPOLOGIA DI DATI (quali tuoi dati personali vengono trattati)

Nel rapporto di coaching vengono trattati dati personali quali:

Nome, cognome, numero di telefono, indirizzo email
Informazioni di natura fiscale, quali partita iva o codice fiscale
Informazioni che il cliente sceglie di condividere con il coach, riguardo a sé, i suoi rapporti lavorativi, i suoi pensieri, riflessioni e decisioni.

FINALITA’ E LICEITA’ DEL TRATTAMENTO (a quale scopo vengono trattati i tuoi dati)

I dati personali relativi al rapporto personale di coaching sono utilizzati dal Coach unicamente per l’erogazione del servizio di coaching richiesto dal cliente, nonché per l’espletamento di obblighi di legge di natura fiscale o previdenziale. I dati personali sono gestiti unicamente da Danilo Tambone, e:

Non vengono condivisi con altri o ceduti a terze parti
Non sono oggetto di profilazioni
Non vengono utilizzati per iniziative di web marketing, a meno che non specificato altrimenti in modo esplicito. Potranno essere utilizzati occasionalmente per un contatto individuale via mail, per mantenere i rapporti o per eventuali proposte mirate.

DESTINATARI (a quali altre figure o enti possono essere comunicati i dati)

Al di fuori del Titolare del trattamento dati, non esistono altre figure incaricate di trattare i dati personali del cliente nello svolgimento dell’attività di coaching e nell’espletamento del contratto tra le parti.

I dati relativi al nome e cognome, e i dati fiscali quali partita iva o codice fiscali vengono comunicati all’interno delle fatture allo Studio La Croce, con sede legale in Via Vittor Pisani 8/a 20124 Milano, unicamente per l’espletamento di obblighi di natura fiscale e/o previdenziale.

DIRITTI (quali sono i diritti che puoi esercitare – Art 11, 12,15,17,18 del Regolamento)

Il cliente ha diritto di conoscere quali suoi dati personali sono stati archiviati e in quale forma, e quali sono le misure di protezione degli stessi messe in atto dal Titolare dei dati. Il cliente ha diritto di accedere ai suoi dati senza oneri, chiederne la modifica o cancellazione, salvo questo ostacoli lo svolgimento dell’accordo contrattuale tra le parti. Il cliente può in ogni momento esercitare il suo diritto di opposizione all’autorità di controllo. Il Titolare dei dati risponde alle richieste del cliente all’indirizzo mail danilo at danilotambone.com.

FONTE DEI DATI (l’origine dei dati trattati)

I dati personali del cliente derivano dall’inserimento dati da parte del cliente nel sito web www.danilotambone.com o da contatti diretti tra il Titolare dei dati e il cliente.

MODALITA’ DI PROTEZIONE DEI DATI (dove e come i tuoi dati sono conservati e protetti da accessi accidentali o illegittimi e da rischio di perdita)

Queste sono le misure di precauzione e sicurezza, organizzative e tecniche, che il Titolare e Responsabile dei dati mette in atto per garantire un livello di sicurezza ai sistemi di archiviazione dei dati adeguato al rischio di sottrazione, modifica o perdita dei dati stessi, nello svolgimento dei rapporti di coaching:

1) Archiviazione dei dati su diversi strumenti informatici: fisici (computer) e in cloud (Area riservata Google drive)

2) Protezione tramite credenziali username e password di tutti gli strumenti informatici utilizzati, fisici (computer) e in cloud (Area riservata Google drive)

3) Modifica regolare ogni 6 mesi delle password di accesso alle cartelle e agli strumenti informatici di archiviazione

4) Al di fuori del Titolare e Responsabile del trattamento dati, non ci sono altre figure incaricate di trattare i dati personali del cliente nello svolgimento dell’attività di coaching e nell’espletamento del contratto tra le parti.

5) Gli strumenti elettronici fisici sono protetti da sistemi antivirus e firewall regolarmente aggiornati e costantemente attivi

6) I programmi per elaborare i dati (sistema operativo Windows 10 e pacchetto Office) sono aggiornati regolarmente secondo le indicazioni del fornitore Microsoft, che ne garantisce la totale rispondenza alle normative e leggi vigenti

7) In caso di perdita dei dati su apparecchi elettronici fisici, copia dei dati è immediatamente recuperabile su Area Riservata Google Drive, accessibile tramite username e password del Titolare e Responsabile del Trattamento dei Dati. PERIODO DI CONSERVAZIONE DEI DATI (per quanto tempo i tuoi dati vengono conservati)

I dati personali vengono conservati in modo sicuro e rispettoso delle norme.

Nel caso dei rapporti di coaching, i dati personali vengono cancellati non prima di 10 anni dal termine del rapporto contrattuale, salvo diversi accordi tra le parti.

CANCELLAZIONE DEI DATI (in che modo i tuoi dati vengono cancellati)

In qualunque momento, se il cliente lo richiede scrivendo a danilo at danilotambone.com, i dati personali registrati e conservati presso il Titolare del Trattamento vengono eliminati da ogni forma di registro, ad eccezione della documentazione fiscale.

TESTIMONIALS

Testimonials video, foto e dichiarazioni sono fornite dai clienti che hanno dato il loro permesso per i testimonial da utilizzare sul sito web Danilo Tambone, Transformative Coaching. Elimineremo e smetteremo di usare il video o l'immagine di una persona su richiesta della persona stessa.

Di tanto in tanto potremmo aggiornare la nostra Informativa sulla privacy. I, Danilo Tambone, based in Milan, Italy, in carrying out my Transformative Coaching activity, declare that I comply with the provisions of EU Regulation 679/2016 - GDPR, in terms of personal data protection, and adopt proactive behaviors and such as to demonstrate the concrete adoption of measures aimed at ensuring the application of the regulation and protecting the rights and freedom of the interested parties. All the relevant information is summarized below.

DATA CONTROLLER (who decides why and how your data are processed, and its references)

DATA PROCESSOR (external figure who, linked by a contract and clear indications from the Data Controller, has access to your data, and his references)

There are no other figures, other than the Data Controller, who have access to data of the customer (coachee).

TYPES OF DATA (which of your personal data is processed)

In the coaching relationships it is managed personal data such as:

- Name, surname, telephone number, email address

- Tax information, such as VAT number or tax code

- Information that the clients choose to share with the coach about themselves, their working relationships, their thoughts, reflections, and decisions.

PURPOSE AND LAWFULNESS OF THE PROCESSING (for what purpose your data is processed)

The personal data relating to the personal coaching relationship is used by the Coach only for the provision of the coaching service requested by the client, as well as for the fulfilment of legal obligations of a fiscal or social security nature. Personal data is managed solely by Danilo Tambone, and:

- It is not shared with others or transferred to third parties

- It is not subject to profiling

- It is not used for web marketing initiatives, unless explicitly specified otherwise. It may occasionally be used for individual contact via email, to maintain relationships or for any targeted proposals.

RECIPIENTS (other figures or entities to whom the data may be communicated)

Other than the Data Controller, there are no other persons in charge of processing the customer's personal data in carrying out the coaching activity and in carrying out the contract between the parties.

The data relating to the name and surname, and the tax data such as VAT number or tax code are communicated within the invoices to Studio La Croce, with registered office in Via Vittor Pisani 8/a 20124 Milan, only for the fulfilment of fiscal and/or social security nature.

RIGHTS (what are the rights you can exercise - Art 11, 12,15,17,18 of the Regulations)

The customer has the right to know which of their personal data have been stored and in what form, and what are the protection measures of the same implemented by the Data Controller. The customer has the right to access their data without charge, to request its modification or cancellation, unless this hinders the performance of the contractual agreement between the parties. The customer can at any time exercise their right of opposition to the supervisory authority. The Data Controller responds to customer requests at the email address danilo at danilotambone.com.

DATA SOURCE (the origin of the processed data)

The customer's personal data derive from the data entry by the customer on the website www.danilotambone.com or from direct contacts between the Data Controller and the customer.

DATA PROTECTION METHOD (where and how your data is stored and protected from accidental or illegitimate access and from the risk of loss)

These are the organizational and technical precautionary and security measures that the Data Controller and Data Processor puts in place to guarantee a level of security to the data storage systems adequate to the risk of theft, modification or loss of the data, in the course of the coaching relationship:

1) Data storage on various IT tools: physical (computer) and in the cloud (Google Drive reserved area)

2) Protection through username and password credentials of all the IT tools used, physical (computer) and in the cloud (Google Drive reserved area)

3) Regular change every 6 months of the passwords to access folders and IT archiving tools

4) Outside the Data Controller and Data Processor, there are no other persons in charge of processing the customer's personal data in carrying out the coaching activity and in carrying out the contract between the parties.

5) Physical electronic tools are protected by regularly updated and constantly active antivirus and firewall systems.

6) The programs to process the data (Windows 10 operating system and Office package) are updated regularly according to the indications of the Microsoft supplier, which guarantees total compliance with the regulations and laws in force.

7) In case of loss of data on physical electronic devices, a copy of the data is immediately recoverable on the Reserved Area on Google Drive, accessible via the username and password of the Data Controller and Data Processor. DATA RETENTION PERIOD (how long your data is kept)

Personal data is stored safely and in compliance with the rules.

In the case of coaching relationships, personal data are deleted not sooner than 10 years from the end of the contractual relationship, unless otherwise agreed between the parties.

DATA CANCELLATION (how your data is deleted)

At any time, if the customer requests it by writing to danilo at danilotambone.com, the personal data registered and stored with the Data Controller is eliminated from any form of register, with the exception of tax documentation.

TESTIMONIALS

Testimonial videos, photos and statements are provided by clients who have given their permission for testimonials to be used on Danilo Tambone, Transformative Coaching website. We will delete and stop using an individual’s video or image at the individual’s request.

HOW WE UPDATE OUR PRIVACY POLICY

We may update our Privacy Policy from time to time. You are advised to review this Policy periodically for any changes, please see the "Last updated" date at the top of this Policy. Changes to this Privacy Policy are effective when they are posted on this page.
